The president can pardon sonmeone for any crimes committed whether the person was charged or not. Ford did that exact thing with Nixon.

If Obama had a sense of humor, which he doesn't, I jokingly said months ago he would issue pardons to all 20 some odd presidential candidates of both parties.

If Obama had a sense of irony, and also the bravery required to risk even a hint of threat to his anticipated after-office riches; he would pardon Bush Junior, Rumsfeld, Cheney and others for War Crimes and Crimes Against Humanity and other crimes . . . and lay out all the particulars in super-detailed pardon statements.
